I think Hill informed me first shortly after my

return from leave and I spoke to Melbourne about it and found it was being done.

Did you gather that the arrangement had been made on behalf of the plaintiffs in the actions, on behalf of the Captain, as representing the Owners of the ship; or on behalf of the Court, in whose custody the ship was?

I came to the conclusion that it was more probably

for the Court that the Bailiff had pledged the credit of the Court. My first idea was that an order had been

obtained but I found that was not so. It was not

specifically said on whose behalf the arrangement had

been made.

What is the present financial position of the

Auctioneering & Co.?

Hopeless.

Have distraints or executions been levied against the Company's property?

There has been a distraint and an execution. The

effects of the Company were actually sold under a distraint
